UPATED HOUSE VOTE WHIP COUNTS: Democrats Still Short on Votes Needed to Ram ObamaCare Through

As we close down for the evening, here is the latest House Vote "Whip Count," this time from several sources we will keep following until the expected vote on Sunday:

Firedoglake (David Dayen) - 203 "Yes" to 210 "No" (With Leaners) / 191-206 without Leaners

Washington Post - 160 "Yes" to 207 "No" with 64 Undecided

NRCC Code Red - 202 "Yes" to 205 "No" with 24 Undecided

All three would agree that Democrats and Obama are still short of what they need for passage of the Senate Health Care Bill in the House. But there are many undecideds, and the pressure has to be tremendous on these Democrats.

Given the Constitution's silence about public healthcare, the 10th Amendment automatically reserves government power to regulate healthcare to the states, not the Oval Office and Congress.

In fact, the USSC has already decided that Congress has no business sticking its big nose into the medical practice.

“Direct control of medical practice in the states is obviously beyond the power of Congress.” --Linder v. United States, 1925.

So if Congress wants to regulate healthcare it must first comply with Article V to have any hope of doing so.

In fact, the tentative yes votes for constitutionally unauthorized Obamacare wouldn't come close to satisfying the 2/3 supermajority votes that Article V requires for both houses of Congress to propose an amendment to the states. And let's not overlook the 3/4 supermajority of the states required to ratify a proposed amendment.

The bottom line is that I hope that Reid and Pelsoi and their colleagues pass Obamacare so that they blow themselves off the political map for their treasonous disregard for the Constitution that they have hypocritically sworn to defend.
